18 U.S.C. §2257 Statement

Last updated: 2026-10-13

All participants and persons depicted in any content on GayBoard must be 18 years of age or older. This page states the service's position on §2257 record-keeping.

18+ only

GayBoard is an adults-only board. Every user affirms they are at least 18 (or the age of majority where they live, if higher), and that any person appearing in an image they upload is at least 18 and consented to being shown. Content involving anyone under 18 is prohibited and removed when reported — see DMCA & Abuse Reporting. The service does not verify age or consent; it relies on user declarations and on the notice-and-takedown process.

How the board handles images

Public advertisements on GayBoard are text only — the public board does not display photographs. If users exchange images at all, they do so only inside private one-to-one messages, and those images are designed to expire automatically shortly after being viewed. The operator does not generate, direct, stage, or take part in the making of any such image.

Record-keeping position

GayBoard is a user-generated advertisement and messaging service. It does not create, produce, publish, manufacture, commission, or control the making of any book, magazine, film, videotape, digital image, or other visual depiction. Users post their own text and, in private messages, their own images, at their own initiative. The operator takes no part in the production of any depiction and exercises no editorial control over its making.

Because GayBoard is not the "producer" of any depicted conduct within the meaning of 18 U.S.C. §2257 and 28 C.F.R. Part 75, the service relies on the exemption available to entities that are not producers and do not conduct the activities listed in 28 C.F.R. §75.1(c) and §75.4. Accordingly, the service maintains no §2257 records and has designated no Records Custodian, because it holds no material to which the record-keeping requirement applies.

If the operator were ever to host or be a producer of material to which §2257 does apply, the required records and a designated Records Custodian would be maintained in accordance with the statute before that material is made available.
